Ok, Congress has been known to do some pretty dumb stuff, but this is a real head scratcher. Turns out some want to criminalize the process of price gouging for high gasoline prices.
The bill is H.R. 5253, the “Federal Energy Price Protection Act of 2006.” In the wake of lower gas prices, I wonder how far this legislation will get in the seven or so legislative days left in this Congress?
Todd Gaziano of the Heritage Foundation has a short article on this very topic here. As Todd notes, not only is this legislation potentially unconstitutional, it also fails to define what “price gouging” really is.
